The Chicago Heights Public Library uses security cameras to enhance the safety and security of library users and staff and to enforce the Library’s Behavior Policy, to assist library staff in preventing the occurrence of any violations of the Behavior Policy or the law, and when necessary, to provide assistance to law enforcement in the apprehension and prosecution of offenders in accordance with applicable federal, state, and local laws.
The Library shall post and maintain signs at the entrance and in other visible areas of the Library to give notices of the use of security cameras for monitoring and recording activity in public areas of the Library property.
Security cameras are located to view service desks, entrances/exits, the exterior of the building, and areas prone to theft, vandalism or other activity that violates Library policy or criminal law. Under no circumstances shall cameras be located in areas where patrons and/or staff have a reasonable expectation of privacy such as restrooms and break rooms.
Video data is recorded and stored digitally and shall be maintained in accordance with applicable law. Recorded data is considered confidential and secure. Access to live feeds of images and recorded data is limited to authorized Library staff designated by the Library Director. The Library intends to cooperate with law enforcement and unless otherwise prohibited by law, law enforcement agencies shall be able to access the outdoor security cameras without a warrant or court order. Since the cameras are not continuously monitored, the public and staff should take appropriate precautions for their safety and the security of their personal property. The Library is not responsible for the loss of property or personal injury.
Video image recordings will be used to identify the person or persons responsible for Library policy violations, criminal activity, or actions considered disruptive to normal Library operations. Video records may be used to assist law enforcement agencies in accordance with applicable state and federal laws. Video recordings of incidents can be retained and reviewed as long as considered necessary by the Library Director. Images may be shared with other Library staff to identify person(s) suspended from Library property and to maintain a safe and secure environment.
Recorded data is confidential and secured in a controlled area. Video recordings will be stored in accordance with applicable law and no less than a minimum of 30 days, provided no criminal activity or policy violation has occurred or is being investigated. As new images are recorded, the oldest images will automatically be deleted.
The Library disclaims any liability for use of the video data in accordance with the terms of this policy, given that the Library is a public facility and the security cameras shall be limited to those areas where patrons and/or staff have no reasonable expectation of privacy.
By using the Library’s facilities, patrons, guests, and staff are implicitly and explicitly waiving any liability related to the recording of their image or activities while at the Library as consistent with this policy.
